BIRTH PHOTOGRAPHY CONTRACT

1. SCOPE OF SERVICES
The Photographer agrees to provide birth photography services for the Client during labor and delivery. Services include:

  • On-call availability starting at 38 weeks.

  • Coverage from active labor through up to 2 hours post-delivery.

  • 35 fully edited high-resolution images.

  • Delivery of final images within 2 weeks.

2. FEES & PAYMENT
Total Fee: $1250
Deposit: $500 (due at signing, non-refundable).
Final Payment: $750 (due by 38 weeks).
Failure to pay may result in contract termination.

3. CLIENT RESPONSIBILITIES

  • The Client must notify the Photographer as soon as labor begins.  The Client must attempt to call the Photographer no less than 2 times to ensure that Photographer is notified of labor.

  • If the Client fails to notify the Photographer in time, the Photographer is not responsible for missed coverage.

  • The Client must ensure hospital or birth center allows photography.

4. COPYRIGHT & IMAGE USAGE

  • The Photographer retains copyright ownership of all images.

  • The Client receives a personal-use license for printing and sharing.

  • The Photographer may use images for marketing with Client’s permission.

5. LIABILITY & FORCE MAJEURE

  • The Photographer is not liable for missed shots due to medical staff restrictions or unexpected circumstances.

  • If the Photographer is unable to attend due to illness or emergency, a backup photographer may be arranged.  If no suitable backup is available, a partial refund and transfer of services to include newborn photography may be arranged.

  • In case of equipment failure or unforeseen circumstances beyond control, liability is limited to refund of fees paid.

6. CANCELLATION & REFUND POLICY

  • If the Client cancels after 38 weeks, no refund will be issued.

  • If the birth is missed due to the Photographer’s fault, a full or partial refund may be provided.
